Kephart Fisher was able to implement its innovative Air Rights Lease Sales Program at this facility. The Air Rights Lease Sales Program was developed in conjunction with one of our developer clients for use by hospital systems in order to align the sometimes competing interests and needs of hospital systems and its physicians. The Program allows the hospitals to retain control over all of the unused space in their medical office buildings and common areas while providing physicians the benefits of real estate ownership. The Program involves a structured transaction whereby the hospital 'sells' air rights to particular spaces in a medical office building for a term of years pursuant to an air rights lease. As developed, the transaction is referred to as a sale but it is not a traditional sale of a fee simple interest in the building; it is a sale of a leasehold estate pursuant to a long term lease, allowing physicians to finance the purchase through a mortgage loan with a lender. The Air Rights Lease Sales Program is a win-win situation for the hospital and physician. It provides control to the hospital and an alternative to short term leasing, tax and other benefits of real estate ownership to the physician. projects/andrews-institute-rendering.jpg Air Rights Lease Sales Of Medical Offices 30 12 00 Sunbury Mills Sunbury Mills Retail Plaza Sunbury, Ohio Sunbury Mills is a 33 acre site located in the Village of Sunbury, Ohio and was originally zoned in 1996 by Kephart Fisher as a mixed-use development incorporating residential, commercial and office components. In 2007, a portion of the site was rezoned by Kephart Fisher to include more retail space, anchored by a Kroger store set to open in late 2008. The rezoning was made possible by the cooperative efforts of the Village of Sunbury Staff, Commissions and Council, the Ohio Departments of Development and Transportation and the Delaware County Commissioners. As a result of this rezoning, significant roadway improvements were made to the intersection of U.S. 36/37 and State Route 3. Along with the Kroger anchor, the retail includes nine possible out lots, including a Tim Horton's restaurant and up to 81,000 square feet of in-line retail space next to the Kroger store.
